Water-Absorbing Toys Recalled Due to Potentially Serious Ingestion Hazard.

On July 31, 2013, the company Be Amazing! Toys announced the recall of nearly 16,000 units of its Water-Absorbing Polymer Balls sold in the United States and Canada. 

The company reports that a potential hazard has been discovered. If a child were to ingest the toys, the balls could expand inside the child’s body, obstructing passageways and causing severe discomfort, dehydration and vomiting.  The balls do not show up on x-rays and, if untreated, the obstructions caused by the balls could be life-threatening.

So far, no personal injuries have been reported from Be Amazing! Toys’ product. But in at least one incident, an 8 month-old girl had to have a similar water-absorbing toy surgically removed.

The balls were sold in stores nationwide and online from September 2010 through November 2012.

Consumers who purchased the product are urged to immediately take the toys away from children and contact Be Amazing! Toys for a full refund.

Nearly One Hundred People Suffer From Salmonella After An Outbreak At A North Carolina Holiday Inn.

Ninety-nine people have suffered from Salmonella food poisoning after eating at the Holiday Inn Bordeaux, a North Carolina hotel. Six victims were hospitalized due to personal injuries sustained from the food poisoning. Of those victims, two have filed lawsuits against the hotel.

In their lawsuits, the food poisoning victims claim that the two contracted Salmonella after eating at Café Bordeaux, a restaurant at the hotel. Both lawsuits seek money damages for the two victims, including lost wages, medical expenses, emotional distress, and pain and suffering.

According to reports from the Cumberland County Department of Public Health, the Salmonella outbreak occurred from food prepared in the Holiday Inn Bordeaux kitchen on May 7-8. The infected food was served at banquets at both the Café Bordeaux and in the hotel’s All American Sports Bar and Grill.

Prevention measures were put in place at the hotel following the accusations. The Salmonella reports have since stopped. The last hotel guest report of Salmonella-like symptoms occurred on May 15th.

$800K Settlement After Borrowed Aerial Lift Collapses Causing Severe Personal Injuries To Operator.

A man was trimming trees near his residence, using an aerial lift borrowed from one of the defendants. The lift had been leased by one of the defendants from another defendant. Suddenly, the lift tipped over and collapsed, hurling the injury victim to the ground.

The man claimed that the lift alarm, which is supposed to activate whenever the lift is stationed on ground with a slope of more than five degrees, failed to activate. An inspection of the scene of the injury accident resulted in a determination that the ground beneath the lift had a slope of well above five degrees.

The injured man brought a lawsuit against the owner, supplier and manufacturer of the lift. The manufacturer settled the products liability lawsuit for $800,000 in mediation, while the lawsuit against the owner and supplier, brought on various causes of actions related to the maintenance and sale of the lift, will proceed to trial.
