Peanut Corporation of America Officials Criminally Indicted In Connection with 2009 Salmonella Outbreak.

According to a statement from the United States Department of Justice issued this past Thursday, former top officials of the Peanut Corporation of America (“PCA”) have been criminally indicted by a federal grand jury in connection with the 2009 salmonella outbreak caused by tainted peanut products.

The federal indictment is charging the officials with fraud, conspiracy and the introduction of adulterated and misbranded food into interstate commerce. The 52-page indictment contains 76 counts of illicit conduct on the part of Stewart Parnell, former president of the liquidated PCA, and three top-level managers.

President Barack Obama has taken personal note of the legal matter. The President is planning to conduct a thorough review of the federal Food and Drug Administration (“FDA”).  The FDA was under intense scrutiny in 2009 for its inability to prevent the salmonella outbreak, and to effectively deal with its consequences.

The 2009 salmonella outbreak caused at least 700 cases of food-borne illnesses and no fewer than nine wrongful deaths.

PCA filed for bankruptcy in 2009 after the outbreak was found to have its source at PCA’s processing facilities in Texas and Georgia.

Massachusetts Girl Awarded $63 Million In Jury Verdict Against Johnson & Johnson.

Samantha Reckis, now 16 years-old, won a $63 million jury verdict against the makers of Motrin (Ibuprofen), Johnson & Johnson, after she suffered a catastrophic drug reaction to the product in 2003. Reckis’s allergic reaction to Motrin caused her to lose 90% of her skin and lose her sight.

Reckis, of Plymouth, Massachusetts, took Children’s Motrin brand Ibuprofen when she was 7 years-old to reduce a fever. Though she had previously taken the drug without any side effects, Reckis suffered a rare allergic reaction to Motrin called toxic epidermal necrolysis. This reaction caused her to lose 90% of her skin and completely lose her sight. Reckis suffered other internal injuries, which reduced her lung capacity to only 20%.

Reckis and her family filed a product liability lawsuit against Johnson & Johnson. In their defective product lawsuit, the Reckis family claimed that the manufacturing giant failed to warn consumers of the life-threatening risks associated with Motrin.

After a trial lasting five weeks, a Plymouth Superior Court jury returned the verdict awarding Reckis $50 million in compensatory damages for her personal injuries, as well as $13 million to her parents for loss of consortium damages.

The award is one of the largest in Massachusetts history.

Nestlé Recalls Line of Lean Cuisine Meals in Alabama.

The Nestlé Prepared Foods Company has recently recalled its Lean Cuisine Culinary Collection Mushroom Mezzaluna Ravioli meals from grocery store shelves and wholesale food warehouses in Alabama.

Nestlé is recalling the meals, because consumers have widely reported finding shards and fragments of glass in the frozen meals. At least three consumers have reported finding glass in the meals. It has not yet been revealed whether any of the consumers suffered personal injuries as a result of the product defect.

The Alabama Department of Agriculture and Industries Food and Safety Division is conducting recall effectiveness checks at stores to ensure that consumers are safe from the defective food product.

The recall only applies to two production codes of the Lean Cuisine Culinary Collection Mushroom Mezzaluna Ravioli meals. Thus far, the recall seems to be limited to grocery stores and wholesale food warehouses located in Alabama.
