Wayne Watson, of Denver, Colorado, won his product liability suit against food companies Gilster-Mary Lee Corp., The Kroger Co. and Dillon Companies Inc., which produced the popcorn that allegedly caused Watson’s lung injuries.
Watson sued the companies soon after developing respiratory problems in 2007. Watson developed lung problems allegedly from inhaling the artificial butter smell which emanated from the popcorn produced by the defendant food companies. The artificial butter smell apparently caused Watson’s lung injuries.
Watson had previously settled his lawsuit against the artificial flavor developer FONA International Inc. for an undisclosed amount.
Watson argued during the trial that the artificial smell caused his personal injuries and that the food companies failed to warn him that the smell could cause a serious lung injury.
The food companies maintained that Watson developed lung problems after years of working with carpet cleaning chemicals.
The jury in the federal court in Denver, CO deliberated for one and a half days before awarding Watson $7.2 million in personal injury damages.
