Missouri Jury Orders Johnson & Johnson To Pay Over $110 Million To Woman Who Developed Cancer.

The law requires that all goods and products that are sold in commerce be of a certain minimum quality, especially when the product is to be used on a person’s body. Many factors affect what those standards are; but if those standards are not met, and you or a loved one is hurt because of someone else’s negligence, you may be entitled to monetary compensation. An expert product liability attorney at the Law Offices of Gilbert R. Johnson & Johnson has been ordered by a Missouri jury to pay over $110 million to a Virginia woman who developed ovarian cancer after decades of using their talc-based products for feminine hygiene. The verdict in state court was the largest so far to arise out of about 2,400 lawsuits accusing Johnson & Johnson of not adequately warning consumers about the cancer risks of talc-based products, including its well-known Baby Powder. This verdict came in a lawsuit against Johnson & Johnson and talc supplier Imerys Talc.

The complaint was filed by Lois Slemp, a resident of Virginia, who is currently undergoing chemotherapy after her ovarian cancer which was initially diagnosed in 2012 returned and spread to her liver. Ms. Slemp claims she developed cancer after four decades of using talc-containing products produced by Johnson & Johnson. The verdict came after Johnson & Johnson secured its first trial win in another Missouri case, when a jury this past March sided with the company in a lawsuit brought by a Tennessee woman who said she developed cancer after using Johnson & Johnson Baby Powder.

Texas Jury Holds Johnson & Johnson Liable For Over $1 Billion In Hip Implant Product Liability Case.

When you go in for a surgery, you expect the best from all parties involved, namely your doctors, nurses, other medical staff, and especially the product manufacturers. What can happen too often when a product manufacturer cuts corners to save money is that they end up producing an inferior product. Even if the surgery goes well, if at any point these products start to become faulty, and you are thereby injured, you may be entitled to substantial compensation for your physical injuries, as well as any other expenses resulting from the manufacturer’s negligence. To help guide you through the complicated litigation process, you should contact one of our expert product liability attorneys here at the Law Offices of Gilbert R. Hoy, Jr. and Affiliates.

Johnson & Johnson has been ordered by a Texas jury to pay more than $1 billion to six patients who claim the company hid flaws in its Pinnacle artificial hips, which had to be surgically removed. Officials of Johnson & Johnson’s DePuy unit, which makes the Pinnacle hips, knew the devices were defective, but failed to properly warn doctors and patients about the risk that they would fail, a federal jury in Dallas recently concluded. The verdict includes more than $30 million in actual damages for the six plaintiffs and more than $1 billion in punitive damages.

The patients in this case alleged that their artificial hips leaked cobalt and chromium material into their bloodstreams, leading to the device failures and the need to be surgically removed. They claimed that Johnson & Johnson officials knew their metal-on-metal design could cause such injuries but nevertheless pushed ahead with the product to rack up billions of dollars in sales.

McDonald’s Orders Recall Of Tens Of Millions OF Fitness Watches After Reports That They Burn Children.

Corporations too often seem to have but one objective: maximizing profits.  This dangerous objective can result in cutting corners and avoiding safety measures. When that happens, a product may be manufactured in a way that makes the product defective or otherwise harmful to consumers.  To protect consumers, there are strict guidelines and mandates that companies must meet and follow with respect to designing and manufacturing their products.  Customers have an understandable expectation that they can rely on the quality and safety of the goods they purchase, and defects that result from a manufacturer’s negligence can result in injury or other damages to the customer.  If you have been harmed because of a defective product, hiring a Boston product liability lawyer expert may be necessary and helpful.

McDonald’s has recently ordered a massive recall of 29 million of their new product, “Step it!” fitness trackers.  The recall came after early reports that they may cause skin irritation and burns to young children.  The new item has been given out with kids meal’s for less than a week and there have reportedly already been 70 instances of burns, blisters, and skin irritations.  The “Step it!” fitness trackers are plastic watches given to children to help them track the number of step they have taken, similar to a discounted version of the fitbit and other fitness trackers.

The material in the device, however, has allegedly caused a severe reaction in dozens of children and McDonald’s voluntarily ordered a recall of every “Step it!” sold or issued.  Currently, the U.S. Consumer Product Safety Commission is investigating the product and its assembly to make sure that it meets all proper federal guidelines.
